Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Detectorist platform, including the website, Android app, and any related services (collectively, "the Platform"). By registering an account or using the Platform, you confirm that you are at least 13 years of age and agree to be bound by these Terms and our Privacy Policy.

2. Beta Service

Detectorist is currently in public beta. This means:

• Features may change, be added, or be removed without prior notice
• The Platform is provided "as is" without warranties of uptime or availability
• We may reset or migrate data during the beta period (we will notify users in advance where possible)
• By using the beta, you accept that the service may contain bugs or instability

3. Account Registration

To use most features of Detectorist, you must create an account. You agree to:

• Provide accurate and truthful information when registering
• Maintain the security of your account password and not share it with others
• Notify us immediately at support@detectorist.zone if you suspect unauthorized access to your account
• Be responsible for all activity that occurs under your account
• Not create multiple accounts to circumvent a suspension or ban

4. User Content

Ownership

You retain full ownership of all content you submit to Detectorist, including finds, session data, photos, posts, and messages ("User Content").

License to Us

By posting User Content on the Platform, you grant Detectorist a non-exclusive, royalty-free, worldwide license to store, display, and distribute your content solely for the purpose of operating and improving the Platform. This license ends when you delete the content or close your account (subject to the 30-day soft-delete retention period).

Your Responsibilities

You are solely responsible for your User Content. You agree that content you post:

• Does not infringe on any third-party intellectual property rights
• Does not contain illegal material including content that promotes illegal metal detecting activities
• Is not defamatory, harassing, abusive, threatening, or discriminatory
• Does not contain spam, unsolicited advertising, or malicious code
• Does not impersonate another person or organization
• Does not violate any applicable laws or regulations

5. Responsible Metal Detecting

Detectorist encourages responsible and legal metal detecting. By using the Platform, you agree to:

• Only detect on land where you have legal permission to do so
• Comply with all local, regional, and national laws regarding metal detecting and archaeological finds
• Report significant historical or archaeological finds to relevant authorities as required by law in your jurisdiction
• Respect private property and natural environments
• Not use the Platform to facilitate or encourage illegal detecting activities

We reserve the right to remove content or suspend accounts that promote illegal detecting activities.

6. Community Guidelines

Detectorist is a community platform. To maintain a positive environment, you must not:

• Harass, bully, or threaten other users
• Share hateful, discriminatory, or extremist content
• Post sexually explicit or graphic violent material
• Spread misinformation or deliberately mislead other users
• Attempt to obtain personal information from other users without their consent
• Use the Platform for commercial solicitation without our prior written consent

7. Moderation

We reserve the right, but are not obligated, to:

• Remove any User Content that violates these Terms or that we deem harmful to the community
• Suspend or permanently terminate accounts that repeatedly violate these Terms
• Issue warnings, mutes, or bans within groups as determined by group owners and our moderation team

Moderation decisions may be appealed by contacting support@detectorist.zone. We aim to respond within 5 business days.

8. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data in accordance with GDPR and applicable privacy laws. By using the Platform, you agree to our Privacy Policy.

9. Intellectual Property

All platform software, design, logos, and brand elements are the intellectual property of Detectorist and may not be used, reproduced, or distributed without our written permission. User Content remains the property of its respective creators.

10. Third-Party Services

The Platform integrates third-party services including Supabase (database), Stripe (payments), and Replit (hosting). Your use of these services is subject to their respective terms of service and privacy policies.

11. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law:

• The Platform is provided "as is" and "as available" without any warranties, express or implied
• We do not guarantee that the Platform will be uninterrupted, error-free, or free of viruses
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
• We are not responsible for the accuracy of find or session data you enter, or for decisions you make based on that data
• Our maximum liability to you for any claim arising from use of the Platform shall not exceed the total amount you have paid to us in the 12 months preceding the claim

Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

12. Termination

You may close your account at any time via Settings → Account. We may suspend or terminate your account if you violate these Terms.

Upon termination:

• Your profile and public content will be removed from the Platform
• Your personal data will be deleted within 30 days in accordance with our Privacy Policy
• Certain data may be retained as required by law

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via the Platform or by email at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden and applicable EU regulations. Any disputes shall be resolved in the courts of Sweden, without prejudice to your rights as a consumer under applicable EU law in your country of residence.
